Competent Supervisor Under the ESA/Human Rights
One of the challenges of being a supervisor or manager is knowing all the legal stuff you have to do. If there’s a collective agreement, then you can follow that, but what about all the legal stuff around hours of work, vacation, or if you have to terminate an employee. Or what if an employee comes to you and shares that they feel that discrimination is happening in their team, and they don’t want to tolerate it anymore. Now what?
Depending upon the size of your organization, you may be able to contact Human Resources/People Services for advice, but you keep thinking that it would be so helpful if ‘I just knew a little more about these topics so that I don’t feel like a deer in the headlights’.
Employment Standards Act and Human Rights for Supervisors and Managers
The Employment Standards Act (ESA) of Ontario provides a legal framework that outlines the minimum standards for most employees working in the province. It covers a wide range of employment aspects, including but not limited to hours of work, termination and severance, leave of absence and equal pay to name a few. The Human Rights Code of Ontario is a provincial law that guarantees equality before the law and prohibits discrimination in specific social areas such as housing, employment, contracts, goods, services, and facilities.
